1. Agreement and who we are
These Terms of Service ("Terms") are a binding agreement between you and ErythrosLight, LLC, a California limited liability company, 2108 N St Ste N, Sacramento, CA 95816 ("ErythrosLight," "we," "us" or "our"). They govern your use of erythroslight.com and store.erythroslight.com, including their pages, content and services (together, the "Site"), and every purchase of our devices, accessories and other products (the "Products").
You accept these Terms when, after being shown a notice that links to them, you click a checkout, order or account-creation button that states you agree to them. Simply viewing the Site does not by itself accept the arbitration agreement in Section 16. If you do not agree to these Terms, do not buy from us.
Our Returns Policy (https://erythroslight.com/returns) and Limited Warranty (https://erythroslight.com/warranty) are part of these Terms. Our Privacy Policy (https://erythroslight.com/privacy-policy) explains how we handle personal information. If any of them conflicts with these Terms, these Terms control, except that Section 16 (Dispute resolution) controls over any dispute term found anywhere else, including in SMS terms, promotion rules or warranty documents, unless that other term expressly states that it replaces Section 16. If a product page or promotion gave you a more favorable return, warranty or price commitment for your order, we honor that commitment.
Accepting these Terms is not consent to optional tracking or marketing. Those are separate choices explained in our Privacy Policy and at sign-up.
2. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract to place an order or create an account. The Products are sold for personal use by you and your household, not for resale or commercial redistribution; wholesale and resale require a separate written agreement, and we may cancel a suspected resale order before shipment and refund it. Our Limited Warranty and Returns Policy apply only to Products bought directly from us or from a retailer we have authorized in writing.
If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. You agree to give us accurate, current and complete information and to keep it updated, and to tell us promptly if you suspect unauthorized use. We may suspend or close an account that violates these Terms; doing so does not affect your rights for Products you already bought.
3. Products, intended use and safety
Regulatory status. Where a Product is described as cleared by the U.S. Food and Drug Administration (FDA) under Section 510(k), that clearance applies only to that Product and to the indications listed on our certifications page (https://erythroslight.com/certifications), together with the clearance number. "FDA-cleared" means the FDA found the device substantially equivalent to a legally marketed device for those indications. It does not mean the FDA approved, endorsed or tested the Product. A Product whose page and labeling do not describe an FDA clearance is not marketed under one. Nothing in these Terms extends a Product's labeling or authorizes a use it does not cover.
Use as directed. Use each Product only for the purposes, on the body areas, in the modes and for the session times described in its Instructions for Use and labeling, including its eye-protection requirements, warnings and contraindications. Read them before first use. Do not modify the Product or use it with accessories we did not supply. Contact support@erythroslight.com if you need the correct manual for your model.
Ask your physician first if you are pregnant or breastfeeding, have a skin condition or a history of skin cancer, take medication or use skincare products that increase light sensitivity, have a seizure disorder or eye condition, or have any other concern about whether light therapy is right for you.
Stop use and contact us at support@erythroslight.com if you experience pain, burning, blistering, swelling, discoloration, persistent redness, eye discomfort or any other unexpected reaction. Seek medical care if a reaction is severe or does not resolve; do not delay urgent care while waiting for our reply. You may also report a device problem to the FDA through its MedWatch program.
Not medical advice. Articles, FAQs, product descriptions, reviews and other content on the Site are general information. They are not medical advice, and they do not create a physician-patient relationship. Results from light therapy vary from person to person, and we do not promise any particular result for you.
Product information. We try to describe the Products accurately, but we do not guarantee that every description, image, specification or price on the Site is error-free or current. If a Product you receive differs materially from its description, contact us; your return and warranty rights and any rights under applicable law remain available.
4. Orders, pricing and payment
Your order. When you place an order, you are offering to buy the Products at the price shown. Our order confirmation email acknowledges that we received your order; we accept it when we ship the Products or, for preorders, as described in Section 5. We may limit quantities, or refuse or cancel an order before shipment for a pricing or stock error, suspected fraud, resale, or a violation of these Terms, and we will promptly refund any amount you paid for a cancelled order. We will not change the price of an accepted order without your agreement.
Prices. Prices are in U.S. dollars unless the Site shows another currency, and they exclude shipping and taxes unless stated. The price in effect when you place your order applies to that order. We may change prices at any time for future orders. If a Product is listed at an obviously incorrect price, we may cancel the order before shipment and refund you in full.
Taxes. We charge sales tax where the law requires it, based on your shipping address.
Payment. You authorize us and our payment processors to charge your chosen payment method for the full order amount. Financing and installment options (such as Affirm or Shop Pay Installments) are separate agreements between you and that provider under its terms, and we are not a party to them. They do not reduce any right you have against us under our warranty or applicable law.
Promotions. Discount codes and offers are subject to the conditions stated with them, cannot be combined unless the offer says so, and cannot be applied to orders already placed. We may end or change a promotion at any time for future orders.
Protection plans. Extended protection plans offered at checkout are sold by Extend, Inc. and its partners under their own terms. We are not a party to those plans.
5. Preorders
A Product marked as a preorder or backorder is not yet in stock. Any ship date shown for it is an estimate, and the product page states when your payment is collected. If we cannot ship by the estimated date, we will notify you with a new estimate and you may cancel for a full refund at any time before the Product ships by emailing support@erythroslight.com. Where the law requires it, we will ask for your consent to the delay and refund you if we do not receive it. Our Returns Policy applies from the day a preordered Product is delivered.
6. Shipping and risk of loss
We ship to the destinations offered at checkout. Delivery dates and transit times are estimates, and we are not responsible for carrier or customs delays outside our control, but a carrier delay does not cancel your rights against us. Risk of loss passes to you when the carrier delivers the Products to the shipping address you provided. You are responsible for entering a correct address; if a package is returned to us because the address was wrong or incomplete, we will tell you the actual reshipping cost before sending it again.
For international orders, import duties, taxes and customs fees are your responsibility unless the checkout states that they are included.
Please inspect your package on arrival and email support@erythroslight.com if it arrived damaged or incomplete, ideally within 14 days of delivery, so we can replace the affected items and file a claim with the carrier. Problems reported later are handled under the Limited Warranty and Returns Policy.
7. Returns, refunds and warranty
60-day money-back guarantee. You may request a return of any Product by contacting support@erythroslight.com within 60 days of delivery, and receive a full refund of the product price as described in our Returns Policy (https://erythroslight.com/returns). Normal use during the 60 days is expected and does not affect your refund. We provide a prepaid return label; ship the return within 14 days after you receive our instructions. There is no restocking fee. For an eligible return, we refund the product price and refundable tax to the original payment method within 7 to 10 business days after receipt, including inspection within that period. The Returns Policy states the condition the Product must be in and how to start a return. We will not add conditions that are not stated there.
Limited Warranty. Each Product is covered against defects in materials and workmanship for the period and on the conditions stated in our Limited Warranty (https://erythroslight.com/warranty). If a covered defect appears during the warranty period, we will repair the Product, replace it, or refund its purchase price, as the Limited Warranty describes. Apart from the Limited Warranty and any additional express warranty stated for your order, we give no other express warranty for the Products. Any implied warranty, including the implied warranties of merchantability and fitness for a particular purpose, is limited in duration to the term of the Limited Warranty for that Product, to the extent the law allows. Some states do not allow limits on how long an implied warranty lasts, so this limit may not apply to you. The Limited Warranty gives you specific legal rights, and you may also have other rights that vary from state to state.
Consumer rights. Nothing in this Section limits any right you have under a law that cannot be waived by contract.
8. Email and text message communications
When you order or create an account, you agree that we may send you transactional messages about your order, account, Product safety or these Terms by email. Marketing email and text-message enrollment are separate choices. We send marketing emails only with your consent, and every marketing email includes an unsubscribe link; unsubscribing does not stop necessary non-marketing messages the law permits.
If you join our text-message program, you give your express written consent at sign-up to receive recurring marketing and transactional text messages from us at the number you provide, including messages sent by automated technology. Consent is not a condition of purchase. Message frequency varies, and message and data rates may apply. Reply STOP to any message to cancel, or HELP for help. You may also ask support@erythroslight.com to stop messages, and we honor other reasonable revocation methods the law requires. Any additional disclosures shown at sign-up also apply. Our Privacy Policy explains how we handle your contact details.
9. Reviews, photos and other content you submit
Your license to us. If you submit a review, rating, photo, video, comment, survey answer or other content to us for publication ("Your Content"), you give us a worldwide, non-exclusive, royalty-free license to display it on the Site with the name or handle you provided and to format it without changing its meaning. If we want to use Your Content, or content you post about us on social media, in paid advertising, we will ask for your permission first, unless a separate agreement with you already covers it. You keep ownership of Your Content. You may ask us to stop using a specific piece of Your Content by emailing support@erythroslight.com, and we will honor the request for future uses. Our Privacy Policy governs any personal information in Your Content.
Your promises. Your Content must be your own honest experience, must not infringe anyone's rights or contain anyone else's personal information, and must not be unlawful, misleading or abusive. If you received a free Product, a discount or any other benefit in connection with your review, you must clearly disclose it in the review.
How we handle reviews. We never condition a benefit on a review being positive, we never condition a refund on withdrawing an honest review, and we do not remove or hide a review because of its rating. We may remove content that is fake, off-topic, defamatory, contains personal information, or violates these Terms, using the same criteria for every review. Nothing in these Terms restricts an honest review or a report to any authority.
10. Intellectual property
The Site and everything on it, including text, images, video, product designs, software, and the ERYTHROS, ERYTHROSLIGHT, Laser Pro Mask and SciLight Pro names and logos, belong to ErythrosLight or our licensors and are protected by copyright, trademark and other laws. You may use the Site to browse and shop and to share links to it. You may not copy, reproduce, scrape, frame, modify, distribute, sell or create derivative works from any part of the Site, or use our names or logos, without our written permission, except as these Terms allow or the law permits.
If you believe content on the Site infringes your copyright, email support@erythroslight.com with the information required by the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), including the work you claim is infringed, the location of the material, your contact details, a statement of good-faith belief, a statement under penalty of perjury that the notice is accurate and that you are authorized to act, and your physical or electronic signature.
11. Prohibited uses
You agree not to:
- use the Site or the Products for any unlawful purpose or in violation of these Terms;
- resell Products, or buy them for resale, without our written permission;
- place orders using false information, another person's payment method without authorization, or bots or scripts;
- abuse a return, warranty or promotional program, including by returning a different or damaged item as if it were the item you received;
- interfere with the Site's security or operation, or attempt to access accounts, systems or data you are not authorized to access;
- use the Site to send spam, malware or unsolicited messages; or
- misrepresent your relationship with ErythrosLight or make claims about the Products on our behalf.
We may cancel orders, refuse service, suspend accounts or take legal action in response to a violation. A restriction does not remove your rights for Products already purchased or your right to make a lawful complaint.
12. Third-party services
The Site uses Shopify for checkout and uses hosting, payment, financing, protection-plan, shipping, review, chat and analytics providers. Links to third-party websites and social media are provided for convenience. We do not control third-party services and are not responsible for their content, policies or practices. Your use of a third-party service, including Affirm, Shop Pay Installments, Extend, PayPal, Amazon Pay, Apple Pay or Google Pay, is governed by that provider's own terms and privacy policy. Our use of a provider does not remove any responsibility the law places on us.
13. Disclaimer of warranties
The Site. The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties about the Site and its content, express or implied, including that the Site will be uninterrupted, error-free or secure, and including any implied warranty of merchantability, fitness for a particular purpose or non-infringement as applied to the Site.
The Products. For the Products themselves, Section 7 applies: the Limited Warranty is our only express warranty, and implied warranties are limited in duration as stated there, not excluded. Nothing in this Section reduces the Limited Warranty, a product description that formed part of your purchase, or any right that the law gives you and that cannot be waived.
14. Limitation of liability
What is excluded. To the fullest extent permitted by law, ErythrosLight and its owners, managers, employees, contractors and suppliers are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or loss of use, arising out of or relating to the Site, the Products or these Terms, even if we were advised that such damages were possible.
Cap. To the fullest extent permitted by law, our total liability for all claims arising out of or relating to a Product is limited to the amount you paid us for that Product, and our total liability for all claims relating to the Site (other than claims about a Product) is limited to US$100.
What is not limited. Nothing in these Terms limits or excludes our liability for death or personal injury caused by a defective Product or by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, for remedies under our return and warranty commitments, or for any other liability, statutory damages, fees or relief that the applicable law does not allow us to limit or exclude. Some states do not allow the exclusion or limitation of incidental or consequential damages, so parts of this Section may not apply to you.
The limitations in this Section are an essential part of the bargain between you and us and apply even if a remedy fails of its essential purpose.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless ErythrosLight and its owners, managers, employees and contractors from any third-party claim, and the reasonable costs of responding to it, that arises out of Your Content, your violation of these Terms or of any law, or your use of a Product contrary to its Instructions for Use. This obligation does not apply to a claim that results from our own negligence, a defect in a Product, our breach of these Terms, or your honest complaint. We may take over the defense of any matter you must indemnify, at our expense, and you agree to cooperate with us.
16. Dispute resolution: binding individual arbitration and class action waiver
Please read this Section carefully. It affects your legal rights. It requires you and us to resolve most disputes through binding individual arbitration instead of in court, it includes a class action waiver, and it gives you the right to opt out within 30 days.
16.1 What this Section covers. This Section applies to every dispute, claim or controversy between you and ErythrosLight (including our owners, managers, employees, contractors, suppliers, successors and assigns) arising out of or relating to the Site, the Products, any purchase, our advertising, our privacy or messaging practices, or these Terms, on any legal theory (a "Dispute"). It binds both of us equally. It applies to Disputes arising from conduct after you first accept it; it does not create consent for a purchase made before you accepted it. Two exceptions: (a) either of us may bring an individual claim in small claims court in the county where you live if the claim qualifies there, without first completing Section 16.3, and the claim stays there unless it is transferred or appealed to another court, in which case it must be arbitrated; and (b) either of us may ask a court for an injunction to stop actual or threatened infringement or misuse of intellectual property, or for temporary relief needed to preserve rights while an arbitration is arranged. Claims that applicable law does not allow to be arbitrated are excluded.
16.2 Federal Arbitration Act. This Section is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq., and evidences a transaction in interstate commerce.
16.3 Informal resolution first. Before starting an arbitration, the party with the Dispute must send the other a written Notice of Dispute. You send yours to ErythrosLight, LLC, Attn: Legal, 2108 N St Ste N, Sacramento, CA 95816, with a copy to support@erythroslight.com. We send ours to the email and mailing address on your most recent order. The Notice must state the sender's name, mailing address and email, the order number(s) involved if any, what happened, and the specific relief requested. Within 60 days after the Notice is received, you and we (with counsel, if either side has one) will hold at least one good-faith conference by phone or video to try to resolve the Dispute; no one has to travel. If the Dispute is not resolved within those 60 days, either party may begin arbitration. Every statute of limitations is paused (tolled) from the day the Notice is sent until the end of the 60-day period. A minor defect in a Notice does not forfeit a claim; the missing information is simply supplied. An arbitration filed before this step is complete will be held until it is completed.
16.4 How the arbitration works. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules and Consumer Due Process Protocol in effect when the arbitration begins, as modified by this Section, and, where they apply, its Mass Arbitration Supplementary Rules. The rules and fee schedules are available at https://www.adr.org. If a procedural provision here conflicts with a mandatory AAA consumer protection, the protection applies. If the AAA is unavailable for reasons unrelated to our failure to comply with its requirements, the parties may agree on a comparable administrator after the Dispute arises, or either may ask a court for any relief available under applicable law. We will not use our failure to pay required fees or comply with the AAA's consumer requirements to force a different administrator or prevent a claim from proceeding in court where the rules or law allow it. A single neutral arbitrator, who must be a retired judge or an attorney with at least ten years of experience, will decide the Dispute. The arbitrator applies the same substantive law, statutes of limitations and privileges a court would apply, and may award you, individually, the same damages and relief a court could award, including individual injunctive relief and attorney's fees where a statute allows them. The arbitrator may allow the discovery needed to resolve the Dispute fairly, considering the amount at stake, and will issue a reasoned written decision. Hearings will be held by video or phone unless the arbitrator decides an in-person hearing is needed, in which case it will be held in the county where you live. Judgment on the award may be entered in any court with jurisdiction.
16.5 Who decides what. The arbitrator decides all questions about the interpretation, scope and enforceability of this Section, with these exceptions that only a court may decide: whether this arbitration agreement was formed and whether a valid opt-out applies, whether the class action waiver in Section 16.7 is enforceable, whether the coordinated-filing procedure in Section 16.9 is enforceable, and whether a claim belongs in small claims court. This paragraph controls over any contrary delegation in the AAA rules.
16.6 Fees. AAA filing and administrative fees and arbitrator compensation are allocated under the AAA Consumer Arbitration Rules and the AAA fee schedule that applies to the case (including the Mass Arbitration fee schedule when it applies). We pay every fee those rules assign to the business, when due. Your filing fee will not exceed the consumer amount under those rules; if you cannot afford it, we will pay it on request. We will not seek our attorney's fees or costs from you in arbitration unless the arbitrator finds that your claim was frivolous or brought for an improper purpose under the standard in Federal Rule of Civil Procedure 11(b), in which case the arbitrator may reallocate fees. Otherwise each side pays its own attorney's fees unless the law or the arbitrator's award provides for them. Nothing here removes your right to recover statutory attorney's fees.
16.7 Class action and representative action waiver. YOU AND WE AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, PRIVATE ATTORNEY GENERAL OR REPRESENTATIVE PROCEEDING, IN COURT OR IN ARBITRATION. The arbitrator may not preside over any class, collective or representative proceeding, may not award relief to anyone other than the individual party, and may not consolidate claims of different people except as Section 16.9 provides; coordinated administration under Section 16.9 is not class arbitration. If a court decides that this waiver is unenforceable as to a particular claim or request for relief, then that claim or request, and only that one, will be decided in court, and the court will decide whether any lawful stay is appropriate.
16.8 Public injunctive relief. If the law that governs your claim does not allow a waiver of the right to seek public injunctive relief (relief that primarily benefits the general public), a claim for that relief may be brought in a court with jurisdiction. The court decides whether any stay or coordination with individual arbitration is lawful and appropriate; this agreement does not require the court claim to wait until arbitration is complete. Nothing in this Section prevents you from reporting a concern to, or filing a complaint with, any government agency.
16.9 Coordinated filings. When similar individual claims qualify under the AAA's Mass Arbitration Supplementary Rules, those rules apply. Each claimant must submit the demand and case-specific information required by the AAA.
Either side may propose coordinated schedules, common discovery, assignment of multiple individual cases to the same arbitrator, or groups of up to 50 cases for administration. Any agreed procedure must satisfy the AAA's applicable rules and due-process requirements, including any requirement for a written agreement after the dispute arises. Each claim receives its own consideration and decision. Grouping does not create a single fee or a consolidated merits hearing.
The applicable AAA process also governs procedural disputes and global mediation. Fees remain governed by Section 16.6. No claimant must wait for another claimant's decision before proceeding unless a lawful procedure agreed after the dispute arises provides otherwise. If a proposed coordination procedure cannot be used, individual arbitration continues under Section 16.4.
16.10 Your right to opt out. You may opt out of this Section 16 by emailing support@erythroslight.com (subject line "Arbitration Opt-Out" is helpful but not required) or by letter to the address in Section 16.3, within 30 days after the date you first accept these Terms (for example, the date of your first order). Include your full name, the email address used for the order or account, and a statement that you are opting out; an order number is helpful but not required. If you opt out, this Section 16 will not apply to either of us, and the rest of these Terms will continue to apply. Opting out has no other effect on your rights, your order, your warranty or your access to customer service. A later purchase does not cancel an earlier opt-out unless you expressly agree to that change.
16.11 Changes to this Section. If we change this Section 16, we will post the revised Terms with a new effective date and email notice of the change, at least 30 days before it takes effect, to every customer who has an account or has placed an order in the previous 12 months. A material change requires your affirmative acceptance after clear notice and an opportunity to review it; posting revised Terms or continued browsing alone is not acceptance. You receive a new 30-day opportunity to opt out of a materially revised arbitration agreement. A change applies only to conduct after you accept it, and never to a Dispute for which a Notice of Dispute or arbitration demand has already been sent. You may reject a change to this Section by emailing support@erythroslight.com within 30 days after the notice; if you do, or you do not affirmatively accept the revision, the version of this Section you last accepted continues to apply to you. A prior opt-out stays in effect unless you expressly revoke it.
16.12 Severability and survival. Except as Sections 16.7, 16.8 and 16.9 provide, if any part of this Section is found unenforceable, that part is severed and the rest of this Section remains in force; no severance creates class arbitration. This Section survives the completion of any order, the end of your relationship with us, and any change to the other Terms.
16.13 Conflicts. This Section governs over any conflicting dispute-resolution term in any other agreement, policy or program between you and us, unless that other document expressly states that it replaces this Section 16.
17. Governing law and venue
These Terms and any Dispute are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law rules, except that Section 16 is governed by the Federal Arbitration Act. If you live in another state or country, you keep any protection of your home law that cannot be waived by contract.
For any matter that Section 16 does not send to arbitration or small claims court, you and we agree to the jurisdiction of the state and federal courts located in Los Angeles County, California, except that a claim for public injunctive relief under Section 16.8 may be brought in any court with jurisdiction over it, and nothing here requires you to waive a non-waivable right to bring a claim where you live.
18. Changes to these Terms
We may update these Terms from time to time. When we do, we will post the revised Terms on the Site with a new effective date. If a change materially reduces your rights or affects purchases, we will also give at least 14 days' notice by email to customers with an account or a recent order, or by a prominent notice on the Site, before the change takes effect. Changes apply only to orders placed and use of the Site after the effective date; an order you already placed is governed by the Terms in effect when you placed it. Changes to Section 16 are governed by Section 16.11.
19. Notice to California residents
Under California Civil Code § 1789.3, California residents are entitled to the following notice. The provider of the Site and the Products is ErythrosLight, LLC, 2108 N St Ste N, Sacramento, CA 95816, support@erythroslight.com. Prices are shown on the Site before you place an order. To resolve a complaint about the Site or the Products, or to receive further information about their use, contact us at support@erythroslight.com. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
20. General terms
Entire agreement. These Terms, together with the Returns Policy, Limited Warranty and any product-specific terms shown at purchase, are the entire agreement between you and us about the Site and the Products, and replace all earlier terms, without erasing a more favorable commitment made for your order or any right the law gives you.
Severability. If any part of these Terms is found unenforceable, that part will be limited or removed to the minimum extent necessary and the rest will remain in force, subject to Section 16.12.
No waiver. Our failure to enforce a term is not a waiver of it.
Assignment. You may not transfer these Terms or your rights under them. We may assign these Terms, without notice, to an affiliate or to a successor in connection with a merger, acquisition or sale of all or substantially all of our assets, and the assignee will honor them.
Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as carrier disruptions, natural disasters, epidemics, government actions, supplier failures or utility outages, but we will tell you about any material delay to your order, Section 5 applies, and your refund rights are not affected.
Electronic communications. You agree that we may communicate with you electronically, and that electronic notices, agreements and records satisfy any legal requirement that a communication be in writing.
Survival. Sections 7, 9, 10 and 13 through 21 survive the completion of any order and the end of your use of the Site.
Headings and language. Headings are for convenience only. If these Terms are translated, the English version controls.
